Danish national individual given suspended prison term for distributing nude film scenes on the social platform Reddit
A Denmark-based man has been convicted of uploading sexually explicit segments from protected films and TV series on the online site Reddit.
According to a law enforcement document reviewed by BBC News, the anonymous man shared 347 video excerpts of explicit scenes in a Reddit group he moderated, which were then watched 4.2 million-plus times.
The country's police state he has been given a 7-month deferred sentence for violating copyright laws.
Experts explain the defendant was charged under a rarely-used clause in Danish copyright law, with the court ruling that by taking the footage out of their intended setting, the man had damaged the artists' "ethical entitlements".
He has additionally been convicted of sharing more than 25 TB of protected digital content.
From spring 2022 to May 2023, the man known as "the pseudonym KlammereFyr" on Reddit uploaded sexually explicit scenes featuring over 100 actresses.
He distributed them in the forum he was a administrator of.
Per the Danish anti-piracy organization the Rights Alliance, his online community had more than 6,000 subscribers and participants were encouraged to request clips of particular performers.
In 2023, campaigners reported the case to the authorities on behalf of the impacted artists, directors and production companies, which resulted in the forum being closed down.
Andrea Vagn Jensen, one of the performers whose explicit scenes were circulated in the community, told Danish broadcasters at the period she felt there was a difference between being seen naked in a movie and appearing on Reddit.
The performer stated the posts amounted to "exploitation".
'A significant signal'
The man was arrested in fall 2024 and admitted culpable to the allegations recently.
In a statement after the ruling, TRA head the organization's leader remarked the outcome sent an "important" signal "indicating infringements of artists' rights has repercussions".
The verdict is considered unique in Denmark for its use of the "moral rights" section of the national copyright law, which specifies an creator's creation cannot be used in a way which violates their standing.
Intellectual property expert Dr Alina Trapova informed the media the case was "rare" for its focus on the harm to the integrity of an artist, rather than to them economically.
How the ruling could affect nations abroad is unclear.
But she added there may be "more and more of these actions" in the coming years with the growth of AI, where "the integrity of an individual's work might be tempered with much more easily".
